Housing eligibility, what is it?

The certificate of accommodation suitability is a document with which, pursuant to the Decree of the Ministry of Health of 5 July 1975, the suitability of an accommodation is declared to accommodate a certain number of people with respect to the rooms of which the accommodation is composed and its overall surface.

The attestation of housing suitability is essential for non-EU citizens to obtain:

the residence contract for subordinate work, including regularization of home helps and carers (Law 102/2009)
the EC residence permit for long-term residents – former residence card – possibly extended to family members
entry for self
-employment reunification of family members, if they are abroad
, the entry of family members following
family cohesion, when the family members are already in Italy.

 

Requirements

 

The certificate of accommodation suitability, issued by the competent municipal offices / ASL, given its nature of attestation of technical or hygienic-sanitary conformity and not a certificate, does not have a time limit and can be validly presented together with the application for a residence permit. EU for long-term residents even beyond six months from its release (see Circular of the Ministry of the Interior of 13/04/2012). If the document also reports the number of residents or simple guests, that part is in the nature of a certificate and, therefore, must be integrated with an updated family status certificate certifying the current number of occupants of the property.
The requirement of housing suitability is not required of the alien holder of international protection and his family members (Article 9, paragraph 1-ter TU Immigration).
