Law 104, what is it?

Law 104 is the legislative reference “for assistance, social integration and the rights of handicapped people.
The main recipients are the disabled, but also those who live with them.
The assumption is in fact that autonomy and social integration are achieved by guaranteeing adequate support for the handicapped person and the family.
And this support can be in the form of personal or family help services, but it can also be understood as psychological, psycho-pedagogical, technical help.

 

Requirements

 

Family employees of severely disabled persons are entitled to paid leave (Article 42 c. 5-5 ter of Legislative Decree 151/2001) lasting, either continuous or split, of 2 years over the entire working life of the applicant. .

Disability is recognized as a percentage so that to obtain benefits, the percentage of disability must be greater than 33.33%, i.e. the ability to work must be reduced by a third

 

 

Law 104: how to get it?

 

The application can be made by: biological parents, adoptive parents or foster parents of disabled children, even if not cohabiting. spouses of employees of persons with severe disabilities. employees relatives of disabled individuals (within the second degree of kinship)

The disabled worker who has been recognized as having a serious handicap has the right to a paid leave of two hours a day or, alternatively, three days of leave a month to be used continuously or in part.
